These “General Conditions of Sale” govern the sale of products marketed by the Febo Davide Farm (hereinafter referred to simply as “Febo Family” ).
The Azienda Agricola Phoebus Davide reserves the right to refuse orders at its own discretion are not inconsistent with its trade policy.
The winery is required to perform only the services specified in the order.
The prices of the products refer to the price list in force at the time of acceptance of the sale offer by the Buyer or at the issue of the order confirmation by the Febo Davide Farm.
The Winery reserves the right to modify the current price list at any time, upon written notice to the Buyer, in the event that there is an increase in the cost of raw materials, labor or any other factor that determines a significant increase. of production costs. The Winery undertakes to communicate any increase promptly to the customer so that he can, if necessary, withdraw from the order. In the event of a change in prices, the delivery of the products will be made after the customer has confirmed their acceptance.
The prices of the products are always understood to be Franco Carrier (FCA Incoterms 2010), except for different written agreements between the parties.
Prices, delivery terms and other information provided by our representatives, agents and sales officials, are valid unless otherwise communicated by Azienda Agricola Febo Davide.
All orders are subject to acceptance by the winery, after checking the actual availability of the products.
Delivery terms: ready. In the event of a temporary lack of one or more products, the winery reserves the right to split up the order by delivering what is available on the requested date and making a subsequent shipment of the products excluded on delivery.
The transport is carried out in free packages specially designed to guarantee the integrity of the bottles.
Shipping: the shipment is made, directly or by courier, carriage paid or assigned, according to agreements and as indicated in the transport document.
In any case, the goods are considered delivered to the buyer with the signature of the delivery documents. The recipient must express the right and duty of control at the time of delivery of the goods and certify the facts to the carrier. He must also check that the packaging is intact, dry, not tampered with or damaged in any way.
If the Customer finds damage and / or obvious anomalies, he must refuse the package (s), and promptly notify the Winery or the representative of the non-collection and the related reasons. This communication can be sent by email, info@famigliafebo.it and must mention the date of the order and the recipient, and the reasons for the non-collection.
The Customer and / or the person in charge of the same to collect the goods is required to check, at the time of delivery and in the presence of the carrier, that the total number of packages corresponds to what was previously communicated to him at the time of shipment.
The goods are guaranteed only if the external packaging is intact in all its parts.
Any complaints regarding the condition of the goods must be received within 8 days from the date of receipt of the goods. The complaint can be sent via email to info@famigliafebo.it
The Cellar does not receive goods returned by the recipient if this is not previously authorized. In the event of an authorized return following complaints highlighted within 8 days of receipt of the goods, the Winery will be responsible for collecting the material object of the return directly or by means of an agreed courier at its expense. The right of withdrawal is however subject to the condition that the purchased good is returned substantially intact: since these are products intended for food consumption, the packages must not have been opened and / or tampered with. In all other cases, the authorized return must be sent to the Winery in free port.
The buyer is required to pay the prices on the invoice without discounts and / or rounding not expressly provided for in the invoice.
Payment must be made with the means and terms provided in the order or according to the agreed agreements. In case of late payment, the winery reserves the right to apply default interest to the extent of current bank rates.
The clauses contained in these general conditions of sale can be waived only by written agreement of the parties.
For any dispute, the Court of Pescara is concurrently agreed as the sole exclusive competent.
Although not expressly provided for in these “General Conditions of Sale”, please refer to the civil, fiscal and criminal legislation in force.
